Terms of Service

Welcome to Cold Board. These Terms of Service ("Terms") govern your access to and use of coldcaseboard.app and related services (the "Service") operated by Cold Board ("we," "us," or "our"). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 13 years old (16 in the EEA) to use the Service. By using the Service, you represent that you meet this requirement and have the legal capacity to enter these Terms.

2. Accounts

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. Notify us immediately of any unauthorized use. We may suspend or terminate accounts that violate these Terms.

3. User-Generated Content

You retain ownership of content you submit ("User Content"). By submitting User Content, you grant us a worldwide, non-exclusive, royalty-free, sublicensable license to host, store, reproduce, modify, display, and distribute it in connection with operating and promoting the Service.

You represent that you have all rights necessary to grant this license and that your User Content does not violate any third-party rights or applicable law.

4. Discussion of Real Cases and Real People

The Service hosts discussion of real criminal cases, victims, suspects, and other persons. You agree that you will NOT:

• Accuse, name, or imply guilt of any specific living person without verified, public-record support
• Post defamatory, libelous, harassing, threatening, or knowingly false statements
• Dox, share private contact details, or otherwise compromise the privacy of victims, suspects, witnesses, or family members
• Engage in vigilantism, harassment campaigns, or coordinated targeting of any individual
• Post graphic, gratuitously violent, or sexually exploitative material
• Interfere with active criminal investigations or violate court orders, publication bans, or victim-protection laws

Theories posted on the Service are speculation, not fact. You are solely responsible for your statements and any legal consequences arising from them.

5. Prohibited Conduct

• Violating any law or third-party right
• Posting spam, scams, malware, or unauthorized advertising
• Impersonating any person or entity
• Attempting to gain unauthorized access to the Service or other accounts
• Scraping or harvesting content except as expressly permitted
• Manipulating votes, points, leaderboards, or other Service mechanics

6. Moderation

We may, but are not obligated to, review, edit, or remove any User Content for any reason, including violations of these Terms. We may suspend or terminate accounts at our discretion.

7. Paid Subscriptions

Certain features require a paid subscription processed by Stripe. Subscriptions renew automatically until canceled. You can cancel at any time from your account; cancellation takes effect at the end of the current billing period. Except as required by law, fees are non-refundable. Prices and features may change with notice.

8. Intellectual Property

The Service, including its design, code, branding, and original content, is owned by Cold Board and is protected by intellectual property laws. You may not copy, modify, or create derivative works of the Service without our written permission, except for your own User Content.

9. DMCA and Takedown Requests

If you believe content on the Service infringes your copyright or other rights, contact us via our Contact page with a detailed description of the material and your contact information. We will respond to valid notices in accordance with applicable law.

10. Disclaimers

The Service is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that User Content is accurate, complete, or reliable. Nothing on the Service constitutes legal, investigative, or professional advice.

11. Limitation of Liability

To the maximum extent permitted by law, Cold Board and its affiliates, officers, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill, arising out of or relating to your use of the Service. Our aggregate liability shall not exceed the greater of (a) the amount you paid us in the 12 months preceding the claim or (b) USD $100. Cold Board is intended for educational, informational, and discussion purposes. User-generated content reflects the views of individual contributors and does not necessarily reflect the views of Cold Board, its management, moderators, or affiliates. Cold Board is owned and operated by Cold Board, LLC, a Florida limited liability company.

12. Indemnification

You agree to indemnify and hold harmless Cold Board from any claims, damages, liabilities, and expenses (including reasonable attorneys' fees) arising from your User Content, your use of the Service, or your violation of these Terms or any law or third-party right.

13. Termination

We may suspend or terminate your access at any time, with or without notice, for any reason, including violation of these Terms. You may stop using the Service at any time. Sections intended to survive termination (e.g., IP, disclaimers, limitation of liability, indemnification) will survive.

14. Governing Law and Disputes

These Terms are governed by the laws of the State of Florida, USA, without regard to conflict of laws principles. You agree to the exclusive jurisdiction of the state and federal courts located in Florida for any disputes arising out of or relating to these Terms or the Service.

15. Changes to These Terms

We may modify these Terms from time to time. If we make material changes, we will update the "Last updated" date and, where appropriate, provide additional notice. Your continued use of the Service after changes take effect constitutes acceptance.
